Copyright and DMCA
Seayora hosts material other people upload — listing photographs, descriptions, documents and messages. If you own a copyright and believe your work has been used here without permission, this page is how you tell us and what happens next. It follows the notice-and-takedown procedure in 17 U.S.C. § 512.
Sending a notice of claimed infringement
Notices of claimed infringement go to our designated agent at [email protected], or through the form on this page. A notice must contain every element § 512(c)(3)(A) requires, or we cannot act on it.
- Your physical or electronic signature, as the owner or an authorised agent
- Identification of the copyrighted work you say has been infringed
- Identification of the material you say is infringing, with the URL of the page it appears on
- Your address, telephone number and email address
- A statement that you have a good faith belief the use is not authorised by the owner, its agent or the law
- A statement, under penalty of perjury, that the information is accurate and that you are authorised to act
What happens, step by step
- We review the notice against the § 512(c)(3)(A) elements. A substantially complete notice is not ignored — we come back to you for what is missing
- If it is complete, we remove or disable access to the material expeditiously
- We notify the person who uploaded it and give them a copy of the notice, as § 512(g)(2)(A) requires
- They may send a counter-notice, and if they do we forward it to you
- The material goes back up in 10 to 14 business days, unless you first tell us you have filed a court action seeking to restrain them
Repeat infringers
- A strike is recorded when we remove material on a properly made notice. A notice we did not act on is not a strike
- A notice listing forty photographs is one strike, not forty — it is one incident by one person
- A strike is withdrawn if a counter-notice is filed and the complainant does not take it to court
- An account reaching three live strikes is reviewed by a person for termination, and we always tell you before an account is closed
- You can see your own strike count at any time on your Safety and account standing page
Sending a notice you should not have
Under § 512(f), anyone who knowingly materially misrepresents that material is infringing is liable for damages, including costs and legal fees, to the person harmed by the wrongful takedown. Trademark, defamation and other non-copyright claims do not go through this procedure — use the report tools or contact support.
