Automatic Lease Renewal Clauses: The Notice That Makes Them Work
In New York and Wisconsin an automatic renewal clause binds a tenant only if the landlord sends a reminder 15 to 30 days before the tenant’s notice deadline.

Short answer: A lease clause that renews the lease automatically unless the tenant gives notice is not enforceable in New York or Wisconsin unless the landlord first reminds the tenant of it. Both require written notice at least 15 and no more than 30 days before the date by which the tenant must give notice. In New York it must be served personally or by registered or certified mail; in Wisconsin it must be given the way the state’s notice statute requires.
Key takeaways
- New York: an automatic renewal clause is not operative unless the landlord gives written notice 15 to 30 days before the tenant’s notice deadline (Gen. Oblig. Law § 5-905).
- New York: the reminder must be served personally or by registered or certified mail.
- Wisconsin: the same 15-to-30-day reminder, given in the manner of Wis. Stat. § 704.21 (§ 704.15).
- Send the reminder inside the window: too early is as ineffective as too late.
Are automatic lease renewal clauses enforceable?
They can be, but some states protect tenants who forget the clause is there. In New York and Wisconsin the clause binds the tenant only if the landlord sends a reminder in a narrow window before the tenant’s deadline to give notice. Other states treat such clauses under general contract law or their own rules, so check where the property is.
What does New York require?
No lease provision stating that the term “shall be deemed renewed for a specified additional period of time unless the tenant gives notice to the lessor of his intention to quit” is operative “unless the lessor, at least fifteen days and not more than thirty days previous to the time specified for the furnishing of such notice to him, shall give to the tenant written notice, served personally or by registered or certified mail, calling the attention of the tenant to the existence of such provision in the lease” (N.Y. Gen. Oblig. Law § 5-905).
What does Wisconsin require?
A residential lease provision for automatic renewal or extension unless notice is given “is not enforceable against the tenant unless the lessor, at least 15 days but not more than 30 days prior to the time specified for the giving of such notice to the lessor, gives to the tenant written notice in the same manner as specified in s. 704.21 calling the attention of the tenant to the existence of the provision” (Wis. Stat. § 704.15).
| Tenant’s notice deadline under the lease | Earliest reminder | Latest reminder |
|---|---|---|
| March 31 | March 1 | March 16 |
| June 30 | May 31 | June 15 |
| September 30 | August 31 | September 15 |
The examples count back 30 and 15 days from the deadline. Calendar both dates when the lease is signed; a reminder mailed two months early does not satisfy either statute.
What about renewals that are not automatic?
These statutes apply only to clauses that renew a lease unless the tenant acts. A renewal offer the tenant must accept is a different process, and in New York City a rent-stabilized tenant’s renewal follows its own rules; see our NYC rent stabilization guide. A change in rent at renewal also needs the notice period the state requires, collected in our rent increase notice rules by state.
Frequently asked questions
Is my lease automatically renewed if I did not give notice?
In New York and Wisconsin, only if the landlord reminded you in writing 15 to 30 days before your notice deadline. Without that reminder the automatic renewal clause does not bind you.
How must a New York landlord send the renewal reminder?
In writing, served personally or by registered or certified mail.
Can a landlord send the reminder early to be safe?
No. The statutes require it at least 15 and no more than 30 days before the tenant’s deadline, so a reminder outside that window does not count.
