Can I claim a penalty for a late first payment?
Not under the voucher contract. Its penalty applies to payments that are late AFTER the first two calendar months of the contract term. Seayora will not draft a claim for the first two months.

The late-payment penalty on a voucher
Part B of the Housing Choice Voucher HAP contract (form HUD-52641, section 7(a)(3)) lets an owner claim a late-payment penalty from the housing agency when a payment is not made promptly AFTER the first two calendar months of the contract term. It is owed only if all three of these are true: a penalty like it is lawful and normal practice where the property is; you charge it to assisted and unassisted tenants alike; and you charge this tenant the same penalty when their own portion is late. It is not owed if HUD decides the delay was beyond the agency’s control, or if the payment was withheld because of a breach of the contract.
- Seayora works out each month’s position for you. Late is judged against the LEASE — its rent due day and grace period — because that is what the contract measures it by.
- The amount is the lease’s own late charge, worked out exactly as it would be for the resident: a flat fee is that fee; a percentage is taken on the agency’s payment.
- A lease with no late fee cannot support a claim, and the first two calendar months of the term never can. Seayora says why beside the month.
- When a month qualifies, Draft a penalty claim asks you to confirm the three conditions, then writes the letter. It is filed in Documents as a PDF and emailed to you. Nothing is sent to the agency.
- When you have sent it, record the date. A claim is drafted once per payment; drafting again returns the same letter.
